1. Acceptance of Terms

Welcome to SheraBot, an AI chatbot application ("Service") provided by SheraAI Technologies ("Company," "we," "us," or "our"), founded by Shaheer.

By accessing, downloading, installing, or using SheraBot, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE SHERABOT.

These Terms constitute a legally binding agreement between you and SheraAI Technologies. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

SheraBot is an artificial intelligence chatbot application that provides:

• Access to multiple AI language models (Gemini 1.5 Pro, Mistral 7B, Llama 3, OpenChat)
• Conversational AI interactions for information, assistance, and entertainment
• Multi-chat session management with history storage
• Cross-platform availability (Android, iOS, Windows, macOS, Linux, Web)
• User account management via Google Sign-In
• Free and premium service tiers

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

3. Eligibility

3.1 Age Requirements

• You must be at least 13 years of age to use SheraBot.
• Users between 13 and 18 years of age must have parental or guardian consent.
• By using SheraBot, you represent and warrant that you meet these age requirements.

3.2 Legal Capacity

You represent that you have the legal capacity to enter into a binding agreement. If you are using SheraBot on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3.3 Geographic Restrictions

SheraBot is available globally, but some features may be restricted in certain jurisdictions due to legal or technical limitations. You are responsible for compliance with local laws.

4. Account Registration

4.1 Google Sign-In

SheraBot uses Google Sign-In for authentication. By creating an account, you agree to:

• Provide accurate information associated with your Google account
• Maintain the security of your Google account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4.2 Account Security

You are solely responsible for:

• Keeping your account credentials confidential
• All activities that occur under your account
• Signing out from shared or public devices

4.3 One Account Per Person

Each individual may maintain only one SheraBot account. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited.

5. Acceptable Use Policy

You agree to use SheraBot only for lawful purposes and in accordance with these Terms. Acceptable uses include:

• Seeking information, assistance, and answers to questions
• Educational purposes and learning
• Creative writing and brainstorming
• Coding assistance and technical help
• General conversation and entertainment

6. Prohibited Uses

You agree NOT to use SheraBot for any of the following purposes:

6.1 Illegal Activities

• Engaging in or promoting illegal activities
• Violating any local, state, national, or international law
• Facilitating fraud, scams, or deceptive practices
• Money laundering or terrorist financing

6.2 Harmful Content

• Generating, requesting, or distributing content that is hateful, violent, abusive, or discriminatory
• Creating content that promotes self-harm or suicide
• Producing sexually explicit or pornographic content
• Generating content that exploits or harms minors in any way
• Creating malware, viruses, or other malicious code

6.3 Deception and Fraud

• Impersonating any person or entity
• Creating fake reviews, testimonials, or endorsements
• Generating misinformation or disinformation
• Phishing or social engineering attacks
• Academic dishonesty or plagiarism

6.4 Privacy Violations

• Collecting or harvesting personal information of others
• Doxxing or revealing private information without consent
• Stalking or harassment
• Non-consensual sharing of intimate content

6.5 System Abuse

• Attempting to reverse engineer, decompile, or hack the Service
• Circumventing usage limits or security measures
• Automated scraping or data mining
• Interfering with or disrupting the Service
• Using the Service for competitive analysis

6.6 Intellectual Property Violations

• Infringing on copyrights, trademarks, or patents
• Generating content that violates third-party rights
• Removing or altering proprietary notices

Violation of these prohibitions may result in immediate termination of your account and potential legal action.

7. AI Disclaimer and Limitations

7.1 Nature of AI Responses

SheraBot uses artificial intelligence to generate responses. You acknowledge and understand that:

• AI responses are generated by machine learning models and may contain errors, inaccuracies, or hallucinations
• AI cannot guarantee the accuracy, completeness, or reliability of any information
• AI responses should not be considered as professional advice of any kind
• AI may produce different responses to the same question
• AI has knowledge limitations and may not have access to current information

7.2 Not Professional Advice

SheraBot does NOT provide and should NOT be relied upon for:

7.3 User Responsibility

You are solely responsible for:

• Any actions taken based on AI responses

7.4 AI Bias

AI systems may exhibit biases present in training data. We work to minimize harmful biases but cannot guarantee their complete absence. Report any biased or harmful responses to our support team.

8. Intellectual Property

SheraBot, including its code, design, logos, trademarks, and content, is the exclusive property of SheraAI Technologies. All rights reserved.

You may not:

• Copy, modify, or distribute any part of the Service
• Use our trademarks without written permission
• Reverse engineer or decompile the application
• Create derivative works based on the Service

8.2 Third-Party Intellectual Property

The AI models used by SheraBot (Gemini, Mistral, Llama, OpenChat) are owned by their respective creators. Their use is subject to their respective licenses and terms.

8.3 Feedback

If you provide feedback, suggestions, or ideas about SheraBot, you grant us a perpetual, irrevocable, royalty-free license to use such feedback without compensation or attribution.

9. User Content

9.1 Your Content

You retain ownership of the content you input into SheraBot (your questions and messages). However, by using the Service, you grant us a limited license to:

• Process your content through AI models to provide responses
• Store your content for chat history functionality
• Use anonymized, aggregated data for service improvement

9.2 AI-Generated Content

Regarding content generated by AI in response to your queries:

• You may use AI-generated content for personal and commercial purposes
• We make no claims of ownership over AI-generated content
• We do not guarantee that AI-generated content is free from third-party rights
• You are responsible for ensuring your use complies with applicable laws

9.3 Content Restrictions

10. Premium Services

10.1 Free Tier

The free tier includes:

• 20 Gemini 1.5 Pro queries per day
• Basic chat history and multi-chat support
• Access to core features

10.2 Premium Tier

Premium subscription includes:

• Unlimited queries with all AI models
• Access to Mistral 7B, Llama 3, and OpenChat
• Priority support
• Additional premium features as released

10.3 Billing and Payments

If you subscribe to premium:

• Payment is processed through the respective app store
• Subscriptions automatically renew unless cancelled
• Prices may change with notice
• No refunds except as required by law or app store policies

10.4 Cancellation

You may cancel your subscription at any time through the app store. Cancellation takes effect at the end of the current billing period.

11. Termination

11.1 Termination by You

You may stop using SheraBot at any time. To delete your account, contact us at contact@shera-ai.com.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to SheraBot at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Prohibited or abusive use
• Fraudulent activity
• Extended inactivity
• Legal requirements
• Discontinuation of the Service

11.3 Effect of Termination

Upon termination:

• Your right to use SheraBot ceases immediately
• Your data may be deleted (subject to legal retention requirements)
• No refunds will be provided for unused premium time
• Sections that should survive termination will remain in effect

12. Disclaimers

• UNINTERRUPTED OR ERROR-FREE OPERATION

12.2 No Guarantees

We do not guarantee that:

• The Service will meet your requirements
• The Service will be available at all times
• AI responses will be accurate, complete, or reliable
• Errors or defects will be corrected
• The Service is free of viruses or harmful components

12.3 Third-Party Services

We are not responsible for any third-party services, including AI model providers, authentication services, or app stores.

13. Limitation of Liability

THIS SECTION LIMITS OUR LIABILITY. PLEASE READ CAREFULLY.

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHERAAI TECHNOLOGIES, ITS FOUNDER, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR USE
• DAMAGES RESULTING FROM AI-GENERATED CONTENT OR RESPONSES
• DAMAGES RESULTING FROM ERRORS, MISTAKES, OR INACCURACIES
• PERSONAL INJURY OR PROPERTY DAMAGE
• INTERRUPTION OR CESSATION OF SERVICE

13.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR
• ONE HUNDRED DOLLARS ($100 USD)

13.3 Basis of the Bargain

YOU ACKNOWLEDGE THAT THESE LIMITATIONS OF LIABILITY ARE AN ESSENTIAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND US, AND THAT WE WOULD NOT PROVIDE THE SERVICE WITHOUT THESE LIMITATIONS.

13.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless SheraAI Technologies, Shaheer (founder), and our officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of SheraBot
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable law
• Content you submit or generate through the Service
• Any dispute between you and a third party

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at contact@shera-ai.com to attempt informal resolution. We will work in good faith to resolve your concerns within 30 days.

15.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of SheraBot shall be resolved through binding arbitration, except as otherwise stated below.

• Arbitration shall be conducted under the rules of a recognized arbitration organization
• Arbitration shall take place in a mutually agreed location or online
• The arbitrator's decision shall be final and binding
• Each party shall bear their own costs, unless otherwise ordered

15.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15.4 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or other urgent matters requiring immediate relief.

15.5 Time Limitation

Any claim or cause of action arising from these Terms or the Service must be filed within ONE (1) YEAR of the event giving rise to such claim, or be forever barred.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to SheraAI Technologies' jurisdiction, without regard to conflict of law principles.

For users in the European Union, nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws in your country of residence.

17. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will provide notice through the app, email, or our website
• Changes become effective immediately upon posting unless stated otherwise
• Your continued use of SheraBot after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using SheraBot.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SheraAI Technologies regarding SheraBot, superseding all prior agreements.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

18.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and SheraAI Technologies.

18.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or infrastructure failures.

18.7 Headings

Section headings are for convenience only and shall not affect the interpretation of these Terms.

18.8 Language

These Terms are written in English. Any translated versions are provided for convenience only, and the English version shall prevail in case of conflict.
